1. Acceptance of Terms

By accessing or using Video Refinery ("the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Nature of Service

Video Refinery is a technical utility providing video and image processing services (including but not limited to AI upscaling, colorization, and format conversion). You acknowledge that AI-driven results are non-deterministic and quality may vary based on source material.

3. User Content & Ownership

Ownership: You retain all ownership rights to the files you upload. Video Refinery does not claim any rights to your content.

Responsibility: You represent and warrant that you own or have the necessary licenses and permissions for all content you upload. You are solely responsible for any copyright infringement resulting from your use of the Service.

Illegal Content: You are strictly prohibited from using the Service to process or store illegal material, including but not limited to child sexual abuse material (CSAM) or content that promotes violence or hate speech.

4. Data Retention & Deletion (The "7-Day Rule")

Temporary Storage: Video Refinery provides temporary storage for processed files for a period of 7 days from the time of completion.

Automatic Purge: Files are automatically and permanently deleted after 7 days. We do not provide backup services. It is your responsibility to download your files promptly.

No Liability for Loss: Video Refinery is not liable for any data loss, including files deleted per our retention policy or due to server failure.

5. Usage Limits & Payments

Free Tier: Limited to 10 files per day and a 250MB per-file limit (subject to change).

Premium Tier: Increased file limits and daily allowances as specified on the pricing page.

Refunds: Due to the high computational cost of AI processing, refunds are handled on a case-by-step basis for technical failures only.

6. DMCA & Copyright Policy

Video Refinery respects intellectual property. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us at [Your Support Email].

Repeat Infringers: We reserve the right to terminate accounts of users who repeatedly infringe upon the copyrights of others.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEO REFINERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

9. Governing Law

These terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
